Terms and Conditions of Sale

Backyards of Katy — a brand of RMF Trading & Services LLC (DBA RMF Global Sourcing) Katy, Texas

By placing an order with Backyards of Katy, the customer accepts these Terms and Conditions in full. These Terms may be updated at any time without prior notice; the version in effect at the time an order is placed governs that order.

1. Trade and Retail Accounts

Backyards of Katy sells to both trade buyers (pool designers, landscape architects, builders, and design-build contractors) and retail customers.

  • Trade accounts receive wholesale/trade pricing and are exempt from sales tax where a valid Texas Sales and Use Tax Resale Certificate is on file. Trade access is granted at Backyards of Katy's discretion following account review. Pricing and tax treatment take effect only once an account has been formally approved — orders placed prior to approval will be processed at standard retail pricing and applicable tax. Purchases are subject to a minimum order of $7,500, which can be waived at Backyards of Katy's discretion.
  • Retail customers purchase at listed retail pricing, subject to a minimum order of $7,500, which can be waived at Backyards of Katy's discretion.

Any terms submitted by the customer via purchase order, email, or otherwise that conflict with these Terms are not binding on Backyards of Katy unless expressly agreed to in writing in advance.

2. Orders

Orders are confirmed once written order confirmation is issued by Backyards of Katy. Order confirmations will indicate an estimated production and ship timeline; actual dates may shift due to production, customs, or ocean freight circumstances outside our control (see Section 4, Lead Time). All order changes or cancellations must be submitted in writing and are subject to Section 6 below given the made-to-order nature of these goods.

3. Payment Terms

Backyards of Katy does not extend credit terms. Accepted payment methods are credit card, ACH, or wire transfer.

  • A deposit of 50% of the order total is due at the time of order confirmation to begin production.
  • The remaining balance is due prior to shipment from origin.
  • Orders will not enter production, and will not ship, until the applicable payment has been received in full.

4. Lead Time

Backyards of Katy's furniture and stone pieces are made to order and imported from Türkiye. Average lead time is 10-14 weeks from order confirmation to delivery, covering production, consolidation, ocean freight, and customs clearance. This is an estimate, not a guarantee — ocean freight schedules, customs processing, and production timing can shift lead times, sometimes significantly. Backyards of Katy will communicate known delays as soon as they are identified and will contact the customer if the estimated lead time changes materially from what was quoted at order confirmation.

5. Shipping and Delivery

Backyards of Katy currently delivers to the Katy and Greater Houston area. Freight and delivery costs are calculated based on order size and delivery location and will be disclosed prior to order confirmation. Special delivery requests (specific access requirements, scheduled install windows, etc.) must be communicated at the time of order; any additional costs associated with special requests are the customer's responsibility. Backyards of Katy does not guarantee exact delivery dates or times.

6. Custom and Made-to-Order Goods — Cancellations

Because pieces are produced to order specifications (stone color, dimensions, configuration, and similar options selected at purchase), orders cannot be cancelled or modified once production has begun. Cancellation requests submitted before production begins may be honored at Backyards of Katy's discretion and may be subject to a cancellation fee to cover costs already incurred.

7. Product Variation

Many Backyards of Katy products are hand-finished concrete or natural travertine stone, produced individually rather than mass-manufactured. Expect natural variation in color, veining, texture, and finish from piece to piece and from images shown online. These variations are characteristic of the material and craftsmanship, not defects.

8. Damages and Claims

Please inspect all deliveries at the time of arrival before signing for receipt. Do not sign for a delivery that shows visible damage without noting it on the delivery paperwork.

  • Damage or discrepancy claims, including photos, must be submitted within 7 days of delivery.
  • Retain all original packaging until the claim is resolved, in case a return or exchange is required.
  • No returns will be accepted without prior written approval from Backyards of Katy.
  • Approved claims will be resolved via repair, replacement (subject to availability), or credit, at Backyards of Katy's discretion.
  • Unauthorized returns or refused deliveries may be subject to a restocking fee and applicable freight charges.

9. Pricing

Prices are subject to change without notice. Trade pricing is available only to approved trade accounts and is not to be shared, quoted, or resold to third parties.

10. Taxes

Texas sales tax applies to all orders unless the customer is an approved trade account with a valid Texas Sales and Use Tax Resale Certificate on file with Backyards of Katy at the time of purchase.

11. Limitation of Liability

Backyards of Katy will make commercially reasonable efforts to deliver goods in accordance with the timelines and specifications provided, but does not guarantee specific delivery dates. Backyards of Katy's liability for any claim relating to an order is limited to the purchase price of the goods in question. Backyards of Katy is not liable for indirect, incidental, or consequential damages arising from delays, product variation as described in Section 7, or third-party installation of purchased goods.

12. Compliance with Laws

The customer is responsible for ensuring that the installation, use, and (where applicable) resale of products purchased from Backyards of Katy complies with all applicable local, state, and federal laws and regulations.

13. Governing Law

These Terms and any dispute arising from an order are governed by the laws of the State of Texas, without regard to conflict of law principles. 

14. Changes to These Terms

Backyards of Katy may revise these Terms at any time. The Terms in effect at the time an order is confirmed apply to that order.
